Lattice — Terms of Service (Alpha)
Lattice is a Japanese-learning app. You have been personally invited to test an early version of it. These terms are short because the product is young and the group is small. They will grow up when the product does, and we will tell you when they change.
1. This is an alpha. Things will break.
You are using pre-release software. That means, honestly:
- Features will be buggy, incomplete, or missing. Some sessions will misbehave without an error message.
- The service can go down at any time, without notice, for any duration. There is no uptime commitment and no availability warranty of any kind.
- We may change, remove, or reset features between one session and the next.
- Data loss is possible. We take backups seriously (see the Privacy Policy for what we store), but you should not treat alpha Lattice as the only home of anything you cannot afford to lose.
If something breaks, please tell us through the in-app bug report (or email). That is a large part of why you are here.
2. Who can use the alpha
- You must be 18 or older. Lattice is not directed at children, and the alpha does not accept anyone under 18.
- You must be located in the United States. The alpha is US-only; we have not done the legal work to offer it anywhere else yet.
- You must have been invited by us. Signup is restricted to invited testers. If you got a link secondhand, ask us before creating an account.
- One account per person, tied to your real email address (we use email magic links to log you in, so it has to actually be yours).
3. The deal: free during alpha
- There are no fees during the alpha. No subscription, no credit card, nothing to cancel.
- Lattice will eventually be a paid product. When paid plans exist, we will announce pricing clearly and in advance, and nothing converts to paid automatically. You will never be silently charged for having been an alpha tester.
- Free alpha access is not a promise of free access later, a locked-in price, or any other future entitlement.
4. Acceptable use
Use Lattice to learn Japanese. Beyond that, common sense, spelled out:
- Do not try to break into the service, probe it for vulnerabilities without asking us first, scrape it, or overload it. (If you find a security issue, we genuinely want to hear about it — email us directly.)
- Do not use the app through automated scripts or bots; the alpha is for human testers.
- Do not use the tutors to generate content that is illegal, harassing, or abusive, and do not attempt to make the service produce such content.
- Do not resell, sublicense, or provide access to your account to anyone else.
- Do not misrepresent who you are at signup.
We can suspend or remove accounts that violate this section (see Section 8).
5. Your data and your content
The short version, with the full detail in the Privacy Policy:
- Your learning data is yours. Your notes, journal entries, learning history, and profile belong to you. You give us permission (a license) to store and process that data to run the service for you — that is what makes the tutor work — and for nothing else beyond what the Privacy Policy describes.
- Voice is handled with specific consent. Speech-based tutoring processes your voice recordings, and we ask for separate, explicit consent for that before any voice capture happens. You can use the non-voice parts of Lattice without granting it.
- You can get your data out, and you can ask us to delete it. During the alpha, both are handled by emailing us; the Privacy Policy describes exactly what is deleted, what is exported, and the narrow records we keep (for example, certain safety-critical audit records are retained even after account deletion, and deletion does not immediately propagate to offline backups).
- Consent choices are currently changed by contacting us, not through an in-app settings screen. That screen is coming; until it exists, email works and we will act on it promptly.
6. Intellectual property
- We own the service. Lattice's software, design, tutor personas, content, models, and everything else that makes the app work are owned by Lattice Language Learning LLC or its licensors. Being a tester gives you a personal, non-transferable, revocable license to use the app during the alpha. It does not give you any ownership, and you may not copy, modify, reverse engineer, or build derivative products from it.
- You own your learning data, as described in Section 5.
- Feedback is a gift we can actually use. If you send us feedback, ideas, bug reports, or suggestions (which is the whole point of an alpha), you grant us a perpetual, irrevocable, royalty-free license to use them — including in the product — without any obligation to you. We will not owe you compensation or credit for feedback, though we will probably thank you anyway.
7. Third-party services
Lattice runs on third-party AI and infrastructure providers (for speech recognition, language models, speech synthesis, and email delivery). What flows to whom, and under what retention terms, is documented in the Privacy Policy. Those providers have their own terms; we pick them deliberately, but we do not control them.
8. Ending things
- You can leave anytime. Stop using the app, and/or email us to delete your account and data (Section 5).
- We can suspend or terminate your access anytime, with or without cause — including for violating Section 4, and including simply because the alpha ends or your account is inactive. This is an invited test, not a service commitment.
- The alpha itself will end. When it does, we will tell you what happens next (a beta, a paid product, or a wind-down) and give you a path to export your data before anything is removed.
- Sections that by their nature should survive termination (IP, feedback license, disclaimers, liability limits, disputes) survive it.
9. Disclaimers
- The service is provided "as is" and "as available", with no warranties of any kind — express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent the law allows.
- No warranty of accuracy: Lattice's tutors are AI systems. They will sometimes teach you something subtly wrong, mistranslate, or misjudge your level. Do not treat tutor output as authoritative; it is a learning aid, not a certified instructor.
- No warranty of availability, data integrity, or error-free operation (see Section 1, which is the honest version of this clause).
10. Limitation of liability
- To the maximum extent permitted by law, Lattice Language Learning LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost goodwill, arising out of the alpha.
- Because the alpha is free, any total liability is intended to be capped at a nominal amount; the specific figure will be set with counsel before these terms are relied upon.
- Nothing in these terms is intended to waive any consumer protection or other right that cannot be waived under the law that applies to you.
11. Governing law and disputes
- The governing law and the specific dispute-resolution process will be finalized with counsel before launch.
- Our intent for a small, invited, free alpha is to keep this non-hostile: email us first, and we will actually respond. Whatever the eventual formal mechanism, informal resolution comes first.
12. Relationship to the Beta Tester Agreement
Alpha testers sign a separate Beta Tester Agreement before onboarding. That agreement, not this document, is where confidentiality lives — what you can and cannot share publicly about unreleased features, screenshots, and the product's inner workings. These Terms of Service govern your use of the service; the Beta Tester Agreement governs your participation in the test program. If the two ever conflict about confidentiality or the testing relationship, the Beta Tester Agreement wins.
13. Changes to these terms
We will update these terms as the product grows (certainly before any paid launch). When we make a material change, we will notify you by email and/or in the app, and continued use after notice means acceptance. For changes to what you have consented to (new data-processing purposes, materially changed terms), we re-ask rather than assume: our consent system is versioned, and a material change requires fresh consent before the affected feature keeps working.
14. Contact
Questions, bug reports, deletion or export requests, security issues, or anything else: david@latticelanguages.com. During the alpha you are talking to the founder, not a ticket queue.
